Abstract

Consumer protection has become a crucial aspect of governance in modern democratic welfare states. In India, the Constitution does not explicitly recognize consumer rights; however, various constitutional provisions collectively establish a strong foundation for protecting consumers against exploitation, unsafe products, deficient services, and unfair trade practices. The constitutional vision of social justice, equality, dignity, public health, and welfare has significantly influenced the development of consumer jurisprudence in India. The enactment of the Consumer Protection Act, 1986 and its replacement by the Consumer Protection Act, 2019 reflect the state's commitment to safeguarding consumer interests in a rapidly evolving marketplace. Judicial interpretation has further expanded consumer rights by linking them with fundamental rights guaranteed under the Constitution. The emergence of e-commerce, digital transactions, and data-driven markets has introduced new challenges requiring innovative legal and regulatory responses. This paper examines the constitutional foundations of consumer protection in India, analyzes relevant constitutional provisions, evaluates judicial contributions, and assesses contemporary challenges in ensuring consumer welfare. The study argues that consumer protection is not merely a statutory objective but a constitutional obligation flowing from the broader commitment to social and economic justice.
